Terms and Conditions 

By tendering any shipment to Crossroads Courier, Inc. (“Crossroads Courier”) for delivery, you (“Customer”) expressly agree to all terms and conditions set forth herein, as well as all charges established in applicable rate sheets, proposals, or agreements. These charges include, but are not limited to, base rates, fuel surcharges, additional and dimensional weight, waiting time, attempt and redelivery, driver sourcing, fleet replacement, and scheduled delivery cancellation fees. You further agree to these terms and conditions on behalf of any third party with an interest in the shipment. You are responsible for ensuring that all shipments are adequately packaged and properly addressed. 

Limitation of Liability 

Crossroads Courier’s liability in connection with each shipment is limited to the lesser of your actual damages or one hundred dollars ($100.00), unless you declare a higher value in writing, pay any applicable additional charge, and provide timely documentation of actual loss. In no event shall Crossroads Courier be liable for any consequential, incidental, special, or punitive damages, including but not limited to lost income or profits, regardless of whether Crossroads Courier had notice of such potential damages. 

Exclusions of Liability 

Crossroads Courier shall not be liable: (i) for your acts or omissions, including but not limited to improper or insufficient packing or labeling, or those of the recipient or any other third party with an interest in the shipment; (ii) if you or the recipient breach these Terms and Conditions; (iii) for shipments of prohibited items; (iv) for any loss, damage, or delay caused by events beyond Crossroads Courier’s control, including but not limited to acts of God, severe weather, war, terrorism, civil commotion, or acts of public authorities; or (v) for damages caused by delay of any kind. 

Declared Value 

Declared value for any item exceeding one hundred dollars ($100.00) must be submitted in writing and accepted by Crossroads Courier prior to pickup and delivery. The maximum declared value permitted is five thousand dollars ($5,000.00). The following are excluded from any liability coverage: cash, currency, coins, negotiable instruments, jewelry, precious metals, furs, fine art, or any other items deemed by Crossroads Courier to be of unusually high value. 

Claims Procedure 

Claims for loss or damage must be submitted in writing to Crossroads Courier, Inc., 2008 Altom Ct., St. Louis, MO 63146, within ten (10) calendar days of occurrence. Written notice must appear on the claimant’s company letterhead and include documentation verifying actual value and proof of loss. No claim shall be processed unless all related delivery charges have been paid in full. Crossroads Courier will review and respond to claims within thirty (30) days of receipt. 

Non-Solicitation of Personnel 

Customer acknowledges that Crossroads Courier invests substantial resources in the recruitment, training, and retention of its drivers and personnel. Accordingly, Customer agrees that, during the term of any service arrangement with Crossroads Courier and for a period of twelve (12) months thereafter, Customer shall not, directly or indirectly, solicit for employment, employ, contract with, or otherwise engage any driver, employee, or contractor of Crossroads Courier without prior written consent. Violation of this covenant shall subject Customer to liquidated damages in the amount of five thousand dollars ($5,000.00) per occurrence, which the parties agree is a fair and reasonable estimate of damages arising from such breach and not a penalty. 

Contractual Priority 

For contracted clients, in the event of any conflict between these Terms and Conditions and the terms of a written service agreement executed by the parties, the terms of the executed contract shall govern. 

Scheduled Delivery Cancellations 

Scheduled delivery cancellations must be submitted in writing at least one (1) business day prior to the date of the next scheduled delivery to avoid being charged the full route price. Cancellation requests should be directed to feedback@crossroadscourier.com and the designated operations office email listed below. Fleet replacement service cancellation obligations are as provided in applicable rate sheets and/or proposals.
